Ofori-Atta Challenges OSP, Kissi Agyebeng in Court Battle

Former Finance Minister Ken Ofori-Atta has initiated legal proceedings against the Office of the Special Prosecutor (OSP) and its head, Kissi Agyebeng, contesting what he describes as an unlawful and damaging declaration of his wanted status. The lawsuit, filed on March 13, 2025, seeks multiple reliefs, including the removal of his name and image from the OSP’s wanted list, an injunction against any attempts to forcibly secure his return to Ghana, and compensation for reputational harm.

Ofori-Atta argues that Kissi Agyebeng, as a lawyer and public officer, failed in his duty to act fairly and reasonably. He asserts that the Special Prosecutor's decision to engage the media instead of following proper legal channels in their interactions constitutes professional misconduct. The former minister maintains that his legal team had already communicated details of his health condition and travel plans, making the wanted declaration unjust and unnecessary.


Among the reliefs sought, Ofori-Atta demands a court declaration affirming that Agyebeng acted unfairly by altering the nature of their engagement through public briefings. He also seeks a directive compelling the OSP to serve any official documents through his legal representatives to ensure compliance with due process. Furthermore, his lawsuit calls for the OSP to retract and remove all published materials branding him as a wanted person.

His legal team argues that the handling of the case has violated his rights, creating an atmosphere of public mistrust. With this lawsuit, Ofori-Atta aims to reaffirm the principles of justice and due process within Ghana’s legal system while challenging what he considers an abuse of power by the Special Prosecutor’s office.
